These Terms of Use and End User License Agreement (“Terms”) govern access to and use of websites, customer portals, applications, online booking tools, payment features, electronic documents, and related digital services operated by Huffman Mechanical LLC, doing business as Huffman Air (“Huffman Air,” “we,” “us,” or “our”).
By accessing or using these services, you agree to these Terms.
1.Our Services
Huffman Air provides heating, ventilation, and air-conditioning services and related digital tools that may allow customers to:
- Request or schedule service
- Review appointments and service information
- Communicate with Huffman Air
- Receive estimates and invoices
- Approve estimates or other documents
- Make payments
- Enroll in or manage maintenance plans
- View service history, equipment information, reports, photographs, and other records
- Receive service-related email or text notifications
Availability of specific features may change over time.
2.Service Requests and Appointments
Submitting an online request does not guarantee an appointment until Huffman Air confirms the request.
Appointment times and arrival windows are estimates and may change due to traffic, prior service calls, weather, emergencies, parts availability, or other circumstances.
You agree to provide accurate contact, property, equipment, and access information when requesting service.
3.Estimates and Authorization
Estimates are based on the information available at the time they are prepared and may change if additional conditions or problems are discovered.
Work will not be performed beyond the scope authorized by the customer unless additional authorization is obtained when required.
Electronic approval, typed-name acknowledgment, checkbox acceptance, digital signature, or another electronic confirmation method may be treated as authorization where permitted by law.
4.Invoices and Payments
Invoices may be delivered electronically.
Payments may be processed through third-party payment providers, including Stripe. Huffman Air does not generally store complete payment-card numbers on its own systems.
You are responsible for reviewing invoices and notifying Huffman Air promptly if you believe an invoice contains an error.
Refunds, credits, deposits, partial payments, and cancellations are subject to the terms shown on the applicable estimate, invoice, membership agreement, or other customer document.
5.Maintenance Plans and Recurring Payments
If you enroll in a recurring maintenance or membership plan, you authorize recurring charges according to the plan terms presented at enrollment.
Plan pricing, covered systems, benefits, discounts, renewal rules, and cancellation terms will be disclosed before enrollment.
Cancellation does not necessarily result in a refund of charges already incurred, except where required by law or expressly stated in the applicable plan terms.
6.Electronic Communications
By providing an email address or phone number, you agree that Huffman Air may send transactional communications relating to:
- Appointments
- Technician arrival or scheduling
- Estimates
- Invoices
- Payments
- Memberships
- Maintenance reminders
- Service updates
- Account or security matters
Marketing communications, where used, will be handled separately from transactional communications when required.
SMS recipients may opt out of applicable text messaging by following the instructions provided in the message, such as replying STOP. Message and data rates may apply.
7.Customer Accounts and Security
If account access is provided, you are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.
You agree to notify Huffman Air promptly if you suspect unauthorized account access.
You may not attempt to bypass authentication, access another person's records, interfere with the service, probe security controls, or use the system for unlawful purposes.
8.Customer Content and Uploaded Materials
You may provide photographs, documents, signatures, equipment information, receipts, notes, and other information through Huffman Air's services.
You represent that you have the right to provide such materials.
You grant Huffman Air permission to store, process, reproduce, and use those materials as reasonably necessary to provide service, maintain business records, comply with legal obligations, resolve disputes, and operate the platform.
9.Third-Party Services
Our services may interact with third-party providers including payment processors, accounting platforms, email providers, identity providers, telecommunications services, and cloud infrastructure providers.
Examples may include Stripe, Intuit QuickBooks, Amazon Web Services, and other providers selected by Huffman Air.
Your use of certain third-party functionality may also be subject to that provider's terms and privacy practices.
Huffman Air is not responsible for interruptions caused solely by third-party services outside our reasonable control.
10.QuickBooks Integration
Huffman Air may use Intuit QuickBooks to maintain accounting and bookkeeping records.
Accounting-related information such as customer identity, invoice references, payments, refunds, credits, vendor expenses, and similar financial information may be transmitted to QuickBooks.
Operational records such as technician notes, equipment diagnostics, photographs, and other service information are not necessarily transmitted to QuickBooks unless required for an accounting purpose.
11.Software License
To the extent Huffman Air provides access to proprietary software, interfaces, or applications, Huffman Air grants you a limited, revocable, non-exclusive, non-transferable license to use those services solely for their intended purpose.
You may not:
- Copy or redistribute the software
- Reverse engineer or attempt to derive source code except where expressly permitted by law
- Bypass access controls
- Introduce malicious code
- Scrape or systematically extract information
- Use the software to interfere with Huffman Air or another user
All rights not expressly granted are reserved.
12.Intellectual Property
The Huffman Air name, logos, branding, website content, software, graphics, forms, and other proprietary materials are owned by or licensed to Huffman Mechanical LLC unless otherwise stated.
These Terms do not transfer ownership of any intellectual property to you.
13.Availability and Changes
We may update, modify, suspend, or discontinue features from time to time.
We do not guarantee uninterrupted or error-free availability.
Maintenance, provider outages, security events, equipment failures, or other circumstances may temporarily affect access.
14.Disclaimer
Digital information provided through the platform is intended to support HVAC service and customer communication.
It is not a substitute for an on-site inspection when an inspection is necessary, and online information should not be relied upon to diagnose dangerous HVAC, electrical, combustion, gas, refrigerant, or indoor-air conditions without appropriate professional evaluation.
15.Limitation of Liability
To the fullest extent permitted by law, Huffman Air will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the website or digital platform.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Separate warranties, guarantees, or remedies applicable to HVAC work are governed by the applicable estimate, invoice, warranty document, manufacturer warranty, or law.
16.Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where federal law applies.
17.Changes to These Terms
We may update these Terms periodically.
When material changes are made, we will update the Effective Date and provide additional notice where legally required.
Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
